Autistic Children sue for their constitutional rights in CanadaÂ’s highest court!

Autism is a devastating neurological condition that science has proven can be overcome with the proper treatment at an early age. After pain-staking reviews, the British Columbia Superior Courts agreed with science and decided that treatment for autistic children is medically necessary and should be provided as part of the childrenÂ’s constitutional rights to proper health care. The federal government blatantly disagrees.

In three separate legal cases heard by three different courts and on three separate occasions, the British Columbia Superior Courts reviewed all the research and listened to arguments pertaining to the value of medical treatment for British Columbia’s autistic children. Each individual case was judged on it’s own merit. In all three cases, the British Columbia Superior Court judgments deemed behavioral autism treatment to be “medically necessary” and to be provided!

In the first case, Auton 2000, [BC Supreme Court] the court clearly stated that the treatment is medically necessary and issued a court order directing the government to pay for treatment. The second case, Auton 2002 [BC Court of Appeal – 3 judges], strengthened Auton 2000 and again ordered the government to pay necessary treatment. The third case, Anderson 2002 [BC Supreme Court] upheld the decision, and ordered the government to stop litigating and pay for the desperately needed treatment of all children with autism. In all three cases the government ignored the court orders and rejected the multiple court rulings outright!

In total disrespect to the Canadian judicial system that they themselves represent, all provincial governments across the country and the federal government are waging a pitched legal battle rather than taking care of its children. The legal maneuver is solely intended to deny Canada’s autistic children their constitutional rights to the treatment they so desperately need and their families cannot afford. This landmark legal struggle for the rights of Canada’s autistic children to necessary medical treatment— the ‘Auton’ case — will be heard before Canada’s highest court in Ottawa on June 9th & 10th, 2004 with all provinces and the federal government intervening against the children. The judgment handed down in the Auton case will have a broad and lasting effect on every single Canadian who is ever in need of any type of health care.

The core of the GovernmentsÂ’ defense is based on autism health care research produced by B. C. Office of Health Technology that is skewed and grossly inaccurate. The Government funded researchers were directed to produce bogus research to defend the government in this autism treatment lawsuit. This act has crossed the humanitarian line and is in total conflict with every single CanadianÂ’s constitutional rights. It begs the question: at what point will the Canadian Government stop wasting taxpayers dollars funding bogus research performed by corrupt professors, and stop using other equally as deceptive tactics solely intended to deny Canadian citizens their constitutional rights to proper health care?

Over thirty years of scientific study have proven that Lovaas-type autism treatment is the only successful treatment for debilitated children with autism. The New York Department of Health and U. S. Surgeon General affirm as much. ItÂ’s the only longitudinal, between-subject designed, matched study in autism treatment research showing the efficacy of the treatment. There have been over half a dozen replications, demonstrating that, in every case, the children in the treatment group SIGNIFICANTLY improved over the control group. In this landmark study published nearly twenty years ago, half of the children were indistinguishable from their peers after only 2 1/2 years of behavioral treatment. Of the remaining children, all made significant gains over their controls.

Despite this, years of legal appeals by governments in many provinces have wasted millions upon millions of the taxpayers dollars, funding court cases instead of funding treatment. The ensuing result of their actions have forced families — who can ill afford it — to devote more of their shrinking incomes to providing the necessary treatment for their children and fight for their constitutional rights to proper health care in court.

The subtext of the ‘AutonÂ’ case is how government funded autism health research is corrupt and hopelessly conflicted. Academic researchers were directed to produce bogus research defending the governmentÂ’s position in the autism treatment lawsuit. Although these researchers write their advocacy research behind the crest of the universities in an attempt to garner legitimacy for their biased work, they cannot avoid the fact that they are 100% funded by Ministries of Health. Their money is often laundered through the university to make it look like its arms length. 

Fortunately, well funded academic mercenaries did not succeed in scuttling this court case: Justice Allan of the British Columbia Supreme Court found Government’s health policy research on autism to be “obviously biased.” Undeterred, government funded health academics are now taking the same distorted autism treatment research to the Supreme Court of Canada on June 9th for the final, decisive legal battle. To add insult to injury, the skewed and grossly inaccurate autism health care research funded by government for the Auton case (produced by B. C. Office of Health Technology) has crossed the Canadian border. It has become a global nuisance causing very real harm to children afflicted with the debilitating disorder of autism worldwide. Simply stated, Canadian junk science is blocking autism health insurance for children around the world – an export we Canadians should not be proud of.

Bottom line: Today, there is a new generation of Canadian children who have unnecessarily lost their futures to the ravages of autism. These children, with the proper treatment, could now be living happy and productive lives had it not been for the endless and inhumane legal maneuvering by government. But instead they are totally dependent on their parents and siblings for their wellbeing. Eventually these children will end up as wards of the state costing the taxpayers millions of dollars. CanadaÂ’s autistic children deserve and must receive the unique treatment that science has proven to be effective - and they so inexcusably have been deprived of. The British Columbia superior courts have already ruled that the treatment is medically necessary and is owed to CanadaÂ’s autistic children as part of their constitutional rights to proper health care.

The stakes are high. On June 9th & 10th the Supreme Court of Canada will preside over whether governmentÂ’s nearsighted bureaucrats have free hand to block desperately needed treatment for CanadaÂ’s children disabled by the devastating neurological condition of autism.

The decision of the court has much bigger implications than merely the impact on Canada’s autistic children. Our constitutional right to proper health care for our “core health need” has never been challenged in the Supreme Court of Canada. Whatever the outcome, it is sure to set a precedent and become the standard by which all future health care decisions are measured.

Statement of Need:

In the past 10 years, five new atypical antipsychotic medications have been FDA-approved as a treatment for schizophrenia. They are collectively placed in the class of atypical, or second-generation, antipsychotics because they all share some advantages over older, first-generation antipsychotics. The distinguishing feature of second-generation antipsychotics is their lower propensity for causing extrapyramidal side effects. They also appear to have a broader spectrum of efficacy in reducing both positive symptoms (hallucinations and delusions) and negative symptoms (amotivation, emotional and social withdrawal), cognitive impairment, mood problems, and perhaps even persistent aggressive behavior. This broader efficacy may be due to differences in the agents’ receptor activity profile. The Clinical Antipsychotic Trials of Intervention Effectiveness (CATIE) trial is the most comprehensive independent trial comparing existing treatments for schizophrenia conducted thus far; however, information available from CATIE on dosing and two newer atypical antipsychotics, ziprasidone and aripiprazole, is limited. In this evidence-based psychCME TV activity, CATIE researchers will discuss these limitations in the context of receptor pharmacology of the atypical antipsychotics and what it means for the clinicians who are responsible for making informed, real-world decisions on dosing in patients with schizophrenia.

CHE, a multi-institutional Catholic health system located within 11 eastern states from Maine to Florida, announced today that effective May 1, 2010, Johnson would assume the post of Executive Vice President, Ministry Operation. In his new role, Johnson will be responsible for mergers and acquisitions for the CHE system, for Regional Health Corporations in the southeast including Holy Cross Hospital and Mercy Hospital, and he will work closely with CEOs throughout the system.

Johnson has served as President and CEO of Holy Cross Hospital since 1998 and of Mercy Hospital since 2008. An active member of the community, Johnson has been recognized with the Alexis De Tocqueville Award from United Way, the Sun-Sentinel Publisher’s Community Service Award and as Leadership Broward Leader of the Year.

Reverend Monsignor Tomas Marin, Chairman of the Board of Trustees of Holy Cross Hospital, announced that Holy Cross Hospital Executive Vice President and COO Patrick Taylor, M. D., MBA, has been promoted to President and CEO of Holy Cross Hospital.

Sr. Barbara Cekosh, SSJ, chairperson for the Mercy Hospital Board of Trustees, announced that Mercy Hospital COO Manuel P. Anton III, M. D., has been promoted to President and CEO of Mercy. Both are effective May 1.

Currently, Dr. Taylor is the Executive Vice President, COO and Chief Medical Director of Holy Cross Hospital, where his primary areas of responsibility include being the physician chief executive of the Holy Cross Medical Group/HCMG (a 111 physician employed multi-specialty group), oversight for the Jim Moran Heart and Vascular Research Institute, continued development of the Centers of Excellence which include the Orthopedic Institute, Jim Moran Heart and Vascular Center, Bienes Cancer Center and responsibility for all facility operations of Holy Cross Hospital.

During his 22 years at Holy Cross, Dr. Taylor has served in increasing levels of management responsibility. He joined Holy Cross as an Emergency Physician in 1988 and quickly advanced to Medical Director of the Emergency Department in 1990 before serving as Executive Director of Medical Affairs for HCMG until 1999. While serving in these capacities, Dr. Taylor pursued formal business training/education and received an MBA. He was promoted to the role of Vice President of HCMG in May of 1999 and implemented a financial turnaround strategy for HCMG. He advanced to Senior Vice President in July 2002 and Chief Operating Officer in September 2006. He has directed strategic, quality and financial turnarounds of hospital operations.

Dr. Taylor received his undergraduate degree from the University of Notre Dame, Doctor of Medicine degree from Duke University and completed his Emergency Medicine Residency at Georgetown/George Washington/University of Maryland combined program. He subsequently completed an Executive MBA at Florida Atlantic University while actively practicing at Holy Cross. Active in the community, Dr. Taylor has served on the Board of Directors of Broward Partnership for the Homeless and Jack and Jill Children’s Center. He previously was a member of the Broward County Regional EMS Council; President of the Caducean Society of Fort Lauderdale; Leadership Broward Class XIV; American Diabetes Association; and Recipient of the 2007 Valor Award.

“It’s great to know John and I will continue to work together as we strive to better serve this community and our patients,” Dr. Taylor said. “He always told me he did not want to be one of those leaders who can’t let go and, consequently, it has been my privilege to work beside him to become intimately familiar with day-to-day operations as well as the intricacies of strategic plans for the development of the hospital.”

Joining Mercy Hospital in 2001 as senior vice president and medical director, Dr. Anton was responsible for the clinical and strategic direction of the organization. In addition to traditional roles of quality, risk and medical staff management, he assumed responsibilities at various times for managed care contracting, patient financial services and business development. In 2008 he was appointed Chief Operating Officer of Mercy Hospital, while retaining prior duties, including overall operational responsibility.

Prior to Mercy Hospital, Dr. Anton served 10 years at the Orlando Regional Healthcare System (Orlando Health). He joined Orlando Health as Assistant Director of Medical Education in Internal Medicine and Director of Quality and Utilization for the Department of Medical Education which cared for the majority of admissions to the medical center. Soon thereafter he was appointed Medical Director for Orlando Regional Home Health and for managed care and was elected Chairman of the Department of Internal Medicine for the flagship 600-bed hospital. During this time, he served on numerous professional advisory committees for managed care organizations including Blue Cross, Prudential and Aetna. Upon departure from Orlando Health, he was Vice President of the managed care subsidiary, Healthchoice, in addition to his medical center related duties. In this role, he provided medical oversight and managed the network development services for a combined managed care enrollment of more than 100,000 members.

Dr. Anton earned his Bachelor of Science and Doctor of Medicine degrees from Emory University. He is board certified in internal medicine having completed his residency with Boston University, where he later served as a clinical instructor. He undertook a Chief Medical Residency at Waltham Weston Hospital and Medical Center. He completed a general medicine fellowship with the Department of Veterans Affairs and undertook health policy and management courses at the Harvard School of Public Health.

Dr. Anton has worked on several State of Florida chartered committees including the Practice Parameters Advisory Committee and the Prostate Cancer Task Force. Miami Today named Dr. Anton among the “Best of Miami 2009 Role Models.” He has given numerous presentations on topics related to healthcare administration. He has been involved in several scientific publications including the oft cited “Comparison of Hospital Costs and Length of Stay Associated with General Internists and Hospitalist Physicians at a Community Hospital,” published in the American Journal of Managed Care. He serves on several nonprofit boards, including Catholic Hospice and the Agrupacion Catolica Universitaria, and volunteers on the Belen Jesuit High school Parent Advisory Council, as well as with the Hispanic Heritage Youth Awards.

As the former district sales manager of a now defunct Internet business, the last place Mark Ayers expected to find himself was in the pest control (http://www. rodenator. com) business, hunting gophers before daybreak. Yet he recently found himself on a Healdsberg, California vineyard, the protector of 650 Zinfandel vines.

The gophers, which voraciously dine on plant roots and can produce up to three litters of young a year, lay entrenched in tunnels beneath Ayers’ feet across 2.5 acres of terraced vineyard. Wielding a wandlike device that injects a mix of propane and oxygen into the pests’ burrows then ignites it, Ayers took the fight to the troublesome varmints.

Five billable hours later, Ayers was $400 richer including a $50 tip the vineyard owner gave him for “sending the critters to gopher heaven.”

“Not bad for a first day’s work,” says Ayers, whose California-licensed pest management company Rodent Eradication Services is off to a roaring start. “In a few months of part-time work, I paid for the equipment. I recently made $3,700 for 5 days work. It doesn’t get much easier.”

Part of the allure of starting a pest control business for burrowing rodents is that the field is wide open. Anywhere plants, crops, or landscaping must be kept healthy or safe is a potential customer. This includes not only agricultural fields, orchards and nurseries but also horse stables, cemeteries, golf courses and schools.

Opportunity stems also from drawbacks in traditional pest control (http://www. rodenator. com) methods, such as time consuming bait traps, poisons that can cause collateral damage to pets that eat poisoned animals, the introduction of natural predators, and shooting.

Another glaring omission in all these traditional methods is they do nothing to remove underground tunnel systems, which new pests can inhabit. New propane-oxygen injection systems like the Rodenator Pro used by Ayers remedy this by destroying the tunnels along with the pests.

“Because oxygen mixed with propane is heavier than air, the mix sinks into the rodents’ tunnels and dens. When it’s ignited it produces an expanding force traveling at 5,000 feet per second,” explains Joe Costigan, a veteran fireman/paramedic in Northeast Oregon who currently runs his company, Underground Pest Control, with the help of his family. “The concussion collapses the tunnel network and produces first pass kill rates up to 90% when I follow up with trapping to catch stragglers.”

Costigan is using the Rodenator Pro to combat a recent population explosion of moles and gophers in Oregon’s Willamette Valley.

“I was trapping 40 gophers a week on one 10 acre property,” explains Costigan. “We cut that to three or four gophers after one pass.”

“When they understand what the Rodenator can do, most bring out lawn chairs, martinis, and invite their friends to watch,” adds Costigan. “As far as they’re concerned, it’s payback time for each gopher that may have wrecked their lawns or savaged their crops.”

Public Officials to Confront Today’s Water Issues at ACE10 in Chicago

AWWA convenes elected, appointed leaders at ‘World’s Water Event’

Denver, CO (Vocus) April 16, 2010

Water commissioners, council members, mayors and other public officials will gather at the Sheraton Hotel and Towers in Chicago, Ill. June 20-24 to immerse themselves in the latest water issues and solutions during the American Water Works Association’s Annual Conference and Exposition (ACE10 (http://www. awwa. org/ace10)).

Public officials will engage in a specialized learning program that includes a three-session, 12-hour certificate program, a Public Officials Breakfast and Caucus, and a networking reception.

Officials can also choose from more than 550 water-related presentations of interest to broader audiences at McCormick Place, and experience more than 500 exhibits featuring water technology solutions.

“Public awareness of water issues continues to grow, and public officials have to be at the top of their game to deal with the hard decisions related to water management and stewardship,” said Michael Bell, chair of AWWA’s Public Officials Forum and board member of the Beaufort-Jasper Water and Sewer Authority in South Carolina. “The education and discussion at ACE10 will help elected and appointed leaders serve their communities with confidence and a clearer understanding of our common challenges.”

Public Officials Breakfast and Caucus
Chicago Water Commissioner John Spatz will provide the opening address during the Public Officials Breakfast and Caucus, to be held Tuesday, June 22 from 8-11:30am. The event – free to public officials who are registered at ACE – also includes speakers who will discuss water communications challenges facing public officials, and tabletop discussions on everything from resource management to finance to workforce solutions. Public Officials Certificate Program
For the second year, public officials registered at ACE10 will have an opportunity to earn the AWWA Public Officials Certificate by participating in three 4-hour courses on June 20-22. Content for the June 22 course, “Water 201: Water Utility Management,” is entirely new, allowing those who have already earned the certificate an opportunity to further expand their knowledge. Courses 1 and 2, to be held June 20 and 21, are “Introduction to Water and Sewer Operating Environments” and “Water and Sewer Infrastructure, Operation and Maintenance.” Renowned water educator Frederick Bloetscher, PhD, P. E., author of Water Basics for Decision Makers (http://apps. awwa. org/EbusMain/Default. aspx? TabId=55&ProductID=6655)], will teach the courses.

“Public officials earning the AWWA certificate will be well-positioned to make informed, smart decisions that impact water management, hiring, finance and more,” Bell said.

Public Officials will have an opportunity to discuss common concerns and share ideas in a relaxed setting during this networking event in Monday, June 21.

ACE10 is the largest and longest-running water event of its kind, featuring a professional program with 550 presentations in 100 separate sessions and in-depth workshops. Among the topics covered will be infrastructure maintenance, climate change, conservation and water efficiency, water resources management, legislative and regulatory issues, managing in a down economy and public affairs. More than 500 exhibitors will also be on-site at McCormick Place, West Building, showcasing the latest products and services available to help ensure safe water.
