That's what the International Premium Cigar & Pipe Retailers Association has been urging since the Pennsylvania smoking ban became law on Sept. 11 and the Philadelphia ban was enacted two years earlier. The state law forbids smoking in most indoor workplaces and public spaces. At the same time, it currently allows a variety of exemptions that some legislators want to eliminate with an amendment in January. Philadelphia's even more stringent ban remains in effect.

Ban the bans. That's what the International Premium Cigar & Pipe Retailers Association has been urging since the Pennsylvania smoking ban became law on Sept. 11 and the Philadelphia ban was enacted two years earlier.

The state law forbids smoking in most indoor workplaces and public spaces. At the same time, it currently allows a variety of exemptions that some legislators want to eliminate with an amendment in January. Philadelphia's even more stringent ban remains in effect.

"The smoking bans should be eliminated, not the exemptions. The bans violate the constitutional rights of private business owners and individual citizens and are based on false information regarding secondhand smoke. Even the Surgeon General's 2006 report says the evidence regarding secondhand smoke is 'insufficient' to draw any conclusions regarding its effect on the health of non-smokers," said Chris McCalla, legislative director of IPCPR which represents more than 70 cigar store owners - largely family-owned businesses - throughout the state.

"In addition to the Surgeon General stating that the evidence is inconclusive regarding the health aspects of secondhand smoke, OSHA - the Occupational Safety and Health Administration - doesn't regard secondhand smoke as an occupational or environmental hazard either," McCalla said.

McCalla pointed out that OSHA has established safe exposure levels for secondhand smoke and has shown that "field studies of environmental tobacco smoke indicate that it would be very rare to find a workplace with so much smoking that (those levels would be exceeded)."

McCalla also cited secondhand smoke air quality testing conducted by the American Cancer Society that showed secondhand smoke concentrations are up to 25,000 times safer than OSHA standards. In addition, he said, Oak Ridge National Laboratory testing confirms that results of air quality testing of secondhand smoke in bars and restaurants "were considerably below limits established by OSHA."

"So, it is with all due respect to the legislature that we believe they got it wrong when it comes to secondhand smoke. As a result, they are unfairly depriving business owners their constitutional rights to run their businesses as they choose," he said.

"Our nation's founders opposed government intervention into matters better left to the people. That includes private property - like businesses - where owners should have the right to decide whether or not to allow smoking on their premises. Customers and employees then have the right to patronize or work at those businesses," he pointed out.

Testimony Encourages Transmission of Narrative Note Information to the EHR using Existing Standards

With almost 20 billion dollars recently earmarked to encourage the adoption of the Electronic Health Record (EHR), The Health Story Project defined "meaningful use of the Certified (EHR)" in its testimony to the National Committee on Vital Health and Statistics' (NCVHS) public hearing in May. The key message; for the creation and exchange of standards-based clinical documentation "meaningful use" must encompass dictation and the detailed narrative. The outcome of this hearing will be submitted to the Centers for Medicare & Medicaid Services (CMS), along with the Office of the National Coordinator for Health Information Technology (ONC). The groups will be developing a proposed rule that provides greater detail on the incentive program and proposes a definition of meaningful use in late 2009.

"Because every national Health Information Exchange (HIE) relies on meaningfully, organized clinical information, creating structured documentation that takes the narrative into account from the beginning is crucial to facilitate the electronic exchange of health information," stated Nick van Terheyden, MD, Interim Executive Committee, The Health Story Project and Chief Medical Officer, M*Modal.

The Health Story Project, founded by M*Modal, American Health Information Management Association (AHIMA), The Association for Healthcare Documentation Integrity (AHDI), and Medical Transcription Industry Association (MTIA) works to develop data standards for common types of electronic healthcare documents to facilitate the smooth transition from unstructured narrative documentation to structured, discrete, and computer-interpretable electronic documentation that will support standardized electronic health records (EHRs).

Sixty percent of the clinical data included in the 1.2 billion clinical documents produced in the United States each year, is comprised of dictated and transcribed documents -- essentially, the narrative that tells the patient's story. This narrative is the information that forms the basis for reimbursement, proof of service, and quality of care between healthcare providers. It serves as the foundation for why physicians initiate orders and make decisions about patient care. Despite these attributes, many industry professionals say the information is "shockingly" underutilized in electronic medical records (EMRs) and other computer-based record systems.

The Health Story Project's testimony was provided on behalf of all parties whose input is critical to making the meaningful use of the certified EHR a success. These include physicians (the overwhelming majority who continue to use dictation); medical records and document management, coding, dictation, speech understanding, natural language processing and EHR vendors; transcription/coding service providers (over 200,000 U. S.-based knowledge workers); and patients who want and deserve access to their complete record, including physician narrative and structured data entry.

While the industry is beginning to recognize the need for the structured narrative, M*Modal has made this possible since 2001 with its advanced Speech Understanding technology. This use of structured narrative and encoded data supports the Committee's observations regarding meaningful use:
 Metrics used in assessing meaningful use need to be easy for providers to report, easy to process for feedback to providers and consumers, adaptable to different clinical environments, and auditable.  EHR technology must support interoperability for care coordination; population/public health management; and accurate quality measurement, reporting, and improvement - all the while being easy to use.  The certification process must ensure flexibility and innovation, and must focus on critical capabilities for meaningful use for each set of intended users.  The role of structured data in support of the definition of qualified EHR and quality measure reporting must be defined. The Health Story Project, founded a little over two years ago, is a collaborative of healthcare vendors, providers and associations that holds an Associate Charter Agreement with Health Level Seven (HL7). This project develops HL7 Clinical Document Architecture Implementation Guides for common types of electronic healthcare documents, brings them through the HL7 ballot process and promotes their adoption within the industry. Over the previous two years, the initiative supported the development of four HL7 CDA Implementation Guides for standard electronic documents, including the Consultation Note, History and Physical, Operative Note and the most recently-announced Diagnostic Imaging Report. Work is now underway to develop a standard for the Discharge Summary.

By using these implementation guides, transcription documents can be imported directly into the EMR and aggregated with other clinical data and clinical information for exchange, reporting, and analysis.

Democratic Vice Presidential Candidate John Edwards made a promise of “no more poverty” at the Democratic National Convention last night, offering as specific proposals more income tax breaks for healthcare, childcare and college tuition. According to Dwight Drake, a law professor and author of the new book Gutless Neglect: AmericaÂ’s Biggest Money Crisis, if Kerry and Edwards are serious about this promise, they should explain why they have supported a grossly unfair tax structure that has punished and continues to punish middle and low-income Americans, minorities and working women far worse than the federal income tax. 

In statements made last night, Drake explained that over the past two decades Americans (primarily middle - and low-income workers) have paid excess payroll taxes of over $1.5 trillion to establish trust funds to pay future baby boomer retirement benefits, but every dime of those funds has been spent on other government programs. For eighty percent of Americans, the payroll tax bite on their incomes exceeds the income tax hit, often by many times. It is a (and some claim “the”) primary reason Americans are the worst savers in the industrial world.

Drake said, “The plan to pre-fund boomer Social Security benefits with high payroll taxes was a con from the get-go in 1983. For nearly two decades, an accounting gimmick has been used to shift huge operating expenses of the Government to low - and middle-income workers. Not a cent has been saved to fund the trillions of dollars promised the boomers. The Government's own accounting people call the trust funds an 'illusion'. The phony trust funds serve only to dupe the American people into thinking their benefits are funded through 2042. What is amazing is that the official Kerry-Edwards website continues to promote this deceptive illusion while labeling as “successful” the shameful, knee-jerk legislation that set the whole mess in motion in 1983.” 

Drake further pointed out that, in 1999, it was Kerry, Edwards and other Senate Democrats who killed a "lock box" bill that would have restricted the governmentÂ’s ability to spend the Social Security trust funds (H. R. 1259). The bill had passed overwhelming in the House by a vote of 416 to 12, and nearly every Senate Republican favored the bill.

“The numbers are huge. For the past three years alone, the average annual payroll tax surplus raid has been about $159 billion. That’s $300,000 of excess taxes taken every minute from hard working Americans to pay other government expenses through a horribly regressive tax that the rich often avoid completely. By way of comparison, that excess payroll tax amount exceeds all incomes taxes paid by all corporations in America over the same time frame. And if something isn’t done, trillions more of excess payroll taxes will be siphoned off over the next ten years to pay other government expenses”. Drake concluded, “No matter how you cut it, it's been a horribly unfair deal for middle - and low-income Americans, minorities and working women. Kerry and Edwards should be explaining why they have opposed efforts to stop this abuse and why they continually ignore the devastating impacts of the federal payroll tax and our runaway unfunded Social Security liability that grows at the rate of $2.7 million a minute.”

As you’re job-searching, keep the following tips in mind:

1. Know and emphasize your strengths. “As a jobseeker, it’s your job to help a potential employer see your strong points,” Troutman says. “Strengths should be highlighted throughout your campaign.”

2. Study the job announcement and tailor your response to it. In working with a jobseeker just hired, resume writer Carla Waskiewicz expanded the applicant’s resume to include more announcement keywords. She also wrote a strong qualifications summary incorporating skills sought.

3. Network, network, network. “This is the most crucial part of the campaign,” says Chad Jones*, who was hired at the Department of Health & Human Services. “When I started, I didn’t know anyone at the division I targeted. But then I got an advocate. It just takes one.”

4. To find contacts, look online for a department’s organizational chart. Chad located and studied organizational charts and department descriptions for two agencies. Once you find a manager’s name on the chart, you may have to work with how the agency’s emails are formulated to get the email address, he says.

5. Collect references from key people familiar with your strengths and talents. Remember to include persons involved in your volunteer or internship activities. Dave Warner, now with the National Institutes of Health, found volunteer activities were instrumental in getting interviews and the job offer.

6. Stay cutting-edge with your skills and training. Especially if you’re unemployed, staying current will be important, reports Troutman.

7. Be realistic about what you can and cannot do. “Applying to do things you cannot do won’t be good for you or the agency,” Troutman cautions. 8. Consider hiring professionals to strengthen your resume and cover letter. On his own, Dave wasn’t getting any nibbles from federal employers. But after his resume was revamped by the Resume Place, he got a series of interviews and was hired.

9. Practice your interviewing skills. “It’s like playing a sport,” says Dave. “If you play the sport once, it won’t result in the same improvement as when you do it regularly.”

10. Have the Placement Program Coordinator work as an advocate to an interested manager. A manager who is considering hiring you may not fully understand Schedule A, Chad points out.

As you go after federal employment, you’ll need to be patient. Chad’s phone interview took place in the beginning of November 2009, but he didn’t receive the job offer until February 2010. He adds that you should also be “persistent and consistent.” After an interview, ask if you can email the contact once a month, he suggests. “The more your name is in front of the hiring manager, the more likely you’ll be hired. Follow up, and stay in touch with your contacts,” he advises. That’s good advice that can pay off.

A few years ago if any one had told Eagle resident, Yvonne McCoy that the nascent industry that she has been working so hard to promote would finally receive its own day or recognition, she probably would not have believed it. McCoy is a virtual assistant, and she along with more than 5,000 other virtual professionals working worldwide will celebrate the first International Virtual Assistants Day (IVAD) on May 19, 2006.

Proposed by the online advocacy group, Alliance for Virtual Businesses (A4VB), IVAD is now officially registered with Chases Calendar of Events, the recognized authority of special days, weeks and months. IVAD will appear in the 2007 edition and will be held annually on the third Friday of May. The inaugural celebration of International Virtual Assistants Day coincides with a three-day assembly sponsored by the Online International Virtual Assistants Convention (OIVAC) running from May 18 – 20, 2006. Virtual Assistants worldwide will display the free IVAD logo and creed on their websites.

“This day of observance not only allows us to celebrate individual accomplishments, but also affords us the chance to pat the backs of our colleagues as well,” says McCoy, whose company specializes in helping business owners with their document, presentation and marketing needs.

McCoy, a former Executive Assistant with over twenty years’ experience, originally conceived the idea for her business in 2004. She started a new career in order to satisfy her entrepreneurial spirit and provide the business community with top quality business services at affordable prices.

Virtual Assistants or VAs are independent entrepreneurs who work remotely and use the latest technology to deliver professional administrative, creative, managerial, technical, business back-office and/or personal support services to busy professionals. Clients only pay for the time actually spent working on projects and often retain a fixed amount of hours per month for service.

Typical services could include everything from general secretarial and word processing services to desktop publishing, website creation and marketing. Projects are often handled over the phone, by fax, e-mail and even instant messaging.
