A Milwaukee family filed suit against Dole today in United States District Court for the Eastern District of Wisconsin (Case No. 06 CV 977).

A Milwaukee family filed suit against Dole today in United States District Court for the Eastern District of Wisconsin (Case No. 06 CV 977). The lawsuit was filed by Marler Clark, the Seattle law firm that filed a similar lawsuit on behalf of an Oregon woman on Thursday*. Plaintiffs in the lawsuit filed today are Milwaukee residents Paul and Anna Zeintek and their two minor children, both of whom were hospitalized with E. coli O157:H7 infections and developed hemolytic uremic syndrome after eating Dole brand baby spinach.

The Zeintek children are two of at least fifty people who are part of a nationwide outbreak of E. coli that the FDA, CDC, and state health departments have traced to contaminated bagged spinach. On September 14, the FDA issued a press release urging consumers to throw away bagged spinach and not to eat the product until its safety could be ensured. Illnesses have been confirmed in Connecticut, Idaho, Indiana, Michigan, New Mexico, Oregon, Utah and Wisconsin. At least eight people developed HUS and one person died as part of this outbreak.

“The fresh produce industry has been plagued with an E. coli problem over the last several years,” said Bill Marler, attorney for the Zeintek family who has represented hundreds of victims of E. coli illnesses since the 1993 Jack in the Box E. coli outbreak. “Dole and other companies who sell ready-to-eat products such as bagged spinach have been working to prevent E. coli from getting into their products; unfortunately for the victims of this most recent outbreak, the prevention measures currently in place were not enough.”

In a very remote prairie in Northern Colorado, a small, elusive species of animal is making a comeback from the brink of extinction.

After a twist of fate 25 years ago when a dog discovered one lone ferret, the black-footed ferret recovery effort has become one of the most successful conservation programs conducted by the US Fish and Wildlife Service in recent history.

Today the Black-Footed Ferret Conservation Center in Colorado has produced more than 5,500 ferrets while in captivity. The center's staff and the animals they are caring for are the subjects of The Futures Channel's latest micro-documentary released on its website today.

"This story about biologists' efforts to rescue the endangered black-footed ferret is inspirational," said Della Garelle, the Black-footed Ferret Species Survival Plan Coordinator at the Cheyenne Mountain Zoo. "It's a real life (and death) application of several scientific principles in order to save an important species right in America's backyard."

In the movie, the biologists at the facility follow a sequence of stages aimed at returning the animals to their natural habitat. "Our main task is to manage black-footed ferrets in captivity, prepare them for reintroduction and release them back into the wild," explains wildlife biologist Paul Marinari, who shows the breeding facilities and preconditioning pens.

One of the most critical elements of the conservation program is breeding healthy ferret offspring or "kits." The breeding rooms are quarantined environments because ferrets are very susceptible to diseases, including human influenza. Each room is filled with a series of tubes and cages that simulate the burrow and tunnel systems that ferrets use in the wild. It is here that the animals develop and learn to adapt to a life underground.

Once they're old enough, the young, naïve black-footed ferret kits are transferred to the outdoor "preconditioning" facility that simulates what it will be like for them to live out on the prairie. "One of the most exciting things that we do here is prepare the animals for release," explained Marinari in the documentary. "They get to experience rain and dirt and wind and all the nighttime sounds in the North American prairie." The micro-documentary, which features Marinari, shows two kits being released for the first time.

In the five-minute movie, Marinari explains how the cause of the near extinction of the black-footed ferret exemplifies the critical interdependence of life. In the wild, black-footed ferrets' diet consists, almost exclusively, of prairie dogs. In the early part of the 20th Century, there was a concerted effort in the West to poison prairie dogs, as they were considered to be pests by farmers. When the prairie dog population began to drop, the black-footed ferrets were nearly wiped out. As a result, these ferrets native to North America were added to the endangered species list.

What was started by the Wyoming Game and Fish Department has become a collaboration of many federal, state and private organizations including the US Fish & Wildlife Service, the American Zoo and Aquarium Association and the Colorado Division of Wildlife. The Black-Footed Ferret Conservation Center has become a model for captive breeding and, ultimately, effectively saving an endangered species.

"It kind of makes you feel good to think that someday black-footed ferrets will be roaming the prairie," said Marinari.

The ICMM is the oldest and largest international military medical organisation, with some 110-member states. Two military physicians, an American and a Belgian, who were disturbed by the medical conditions and treatment of the soldiers, founded it in 1921 at the conclusion of World War I. ICMM is an intergovernmental organization that has official relations with the World Health Organization and International Committee of the Red Cross.

In an abstract submitted to the Scientific Committee of the ICMM, Ayuba had stated that Jobelyn is “a good alternative and/or supplement to antiretroviral drugs in the management of HIV/AIDS patients.”

Ayuba had, together with Dr. Patrick Erah of the Department of Clinical Pharmacy and Pharmacy Practice, University of Benin conducted clinical studies with 64 HIV/AIDS patients who were regularly attending clinic at Military Hospital, Lagos. The overall objective of the study was to evaluate the efficacy of Jobelyn, in enhancing cellular immunity in HIV infected patients. Based on his studies and abstracts sent to the ICMM, Ayuba was invited to make a poster presentation of Jobelyn.

In one of the presentations which was an excerpt from the World Health Organisation: World Health Report, 2003 HIV/AIDS is ranked second in the table of leading infectious causes of Death Worldwide in 2002 with 2,821,000 annual deaths.

Addressing delegates at the five-day congress, Ovadje explained that Jobelyn is not only effective for HIV/AIDS but it is beneficial in very many other ways.

He said: “Free radicals have been implicated in the development of at least 60 diseases including heart diseases and cancer which are the leading causes of death in the world. If there’s a silver lining to the tragic urban stories, it’s that Jane Otai (http://www. jhpiego. org/whatwedo/urbanslums. htm), a Kenyan health worker, has used the worldwide attention to focus on bringing hope and real change to those often hopeless slums. Over the past five years, her work in the Nairobi slums of Korogocho and Viwandani has empowered residents through community outreach and health education programs. She has played a pivotal role in bridging the cultural and social divide between government-run health clinics and communities to ensure that women have access to services for safe motherhood and care of their children. Otai, from a global health non-profit organization affiliated with Johns Hopkins called Jhpiego, has pioneered new approaches to involving residents in decisions about the health of their families and now hopes to share her methods around the globe. Otai will be in the U. S. from April 4–16 and will speak about her work at various events including one at the Wallace Global Fund on Tuesday, April 6.

More than half of humanity now lives in an urban setting. Africa is urbanizing faster than any other continent and, according to a 2007 report by the United Nations Population Fund, an astonishing 72 percent of urban residents live in slums. The city of Nairobi, Kenya, has seen this explosion of growth. The residents of the capital’s slums face the risk of death, disease and violence daily. However, global organizations like Jhpiego, the Rockefeller Foundation, Bill & Melinda Gates Foundation and the Wallace Global Fund are making progress and improving the lives of urban dwellers. Here are some examples:
 Increased Access to Health Care—Jhpiego has trained more than 200 slum-based health care providers, who have reached more than 250,000 people. These workers connect community residents to a variety of health services including reproductive and maternal and child health, nutrition, sanitation and disease prevention.  HIV Counseling and Treatment—Of the 10,653 clients accessing antenatal care, 80 percent received services for prevention of mother-to-child transmission of HIV. Services for HIV-positive residents were expanded through establishment of four comprehensive care clinics.  Family Planning Services—Through community health programs and educational outreach, Jhpiego health care workers have raised the level of acceptance of family planning options among residents. Chelation (pronounced key-LAY-shun) therapy is an investigational therapy using a man-made amino acid, called EDTA. It is added to the blood through a vein. A national research study is now testing whether chelation therapy is safe and effective for treating heart disease.

Many people are considering using chelation therapy because of the belief that it may treat heart disease. However this has not been scientifically proven. Past studies did not show benefit, but may have been too small to be conclusive. That is why the National Institutes of Health is conducting this large study to find out whether chelation therapy is safe and effective in treating heart disease.

Where is the study taking place?

The study is taking place at more than 100 medical centers, clinics, and physicians' offices across the country. The Longevity Centre of Houston has been chosen by the NIH to serve the Houston Metro region.

With the implementation of The U. S. Department of Health and Human Services new greatly expanded ICD-10 code set slated for mandatory compliance by Oct. 1, 2013, Capture Billing & Consulting, Inc. Capture Billing will assist medical practices in becoming compliant with minimal cost and effort in order to successfully transition to ICD-10. ICD-10 replaces the old ICD-9 code set used to report health care diagnoses and procedures with an overwhelming 120,000 new codes. These codes are used by physicians and other healthcare providers to classify and report diseases, and are much more specific than the old codes. Capture Billing is committed and prepared to help medical practices smoothly transition to the new codes.

Capture Billing will educate physicians and their staff, work with computer systems and software to update code tables, rework superbills, and generally take on the burden of IT system changes. Even though ICD-10 is a few years away, healthcare providers must begin preparing for ICD-10 now. This will require physicians to work with all of their software vendors to implement ICD-10. The overall process will be a very time consuming endeavor.

Moving to ICD-10 will require a tremendous effort and incur incredible cost for healthcare organizations. The costs of medical software, computers, training and IT support will be staggering.

Several organizations such as the MGMA (http://www. mgma. com), AMA (http://www. ama-assn. org) and the AAPC (http://www. aapc. com) have estimated the cost of a three-physician practice implementing ICD-10 to be about $83,000. A 10-physican practice will cost more than $285,000. “The goal at Capture Billing is to minimize the financial impact on the medical practice”, said Manny Oliverez, Director of Operations for Capture.

Healthcare providers, medical offices and hospitals must be in compliance as the old ICD-9 codes will not be accepted after that date. Physician offices that submit claims using the old codes will not get paid.
