City of Azusa Sued by Azusa Pacific University Student Over Dangerous Roads
The City of Azusa, California, is being sued by Azusa Pacific University student Julie Farris for failing to properly design and maintain its roads. Farris was forced to maneuver her bicycle around a parked car and into the path of the Azusa Pacific University trolley. The accident caused severe personal injury, including head trauma. The City of Azusa, California, is being sued by Azusa Pacific University student Julie Farris for failing to properly design and maintain its roads, causing her Farris severe personal injury. According to court documents and the police report, on February 19, 2008, student Julie Farris was riding her bicycle eastbound on East Foothill Boulevard in Azusa. As there were several cars parked along the roadway narrowing her right-of-way, Farris was forced to swerve her bicycle around them and into the path of the Azusa Pacific University trolley traveling westbound. The ensuing collision with the trolley knocked Farris off her bicycle, causing her severe personal injury, including head trauma. She was flown by helicopter to U. S.C. County Medical Center where she immediately underwent surgery. Farris is now permanently disabled.
Court documents state the City of Azusa failed to properly design and maintain Foothill Boulevard, as it lacked a crosswalk or traffic signal that would have allowed pedestrians and bicyclists to cross the roadway safely. The roadway also lacked sidewalks or bike paths that would have allowed pedestrians and bicyclists to travel safely, away from traffic.
The complaint also asserts that the trolley driver was inattentive, and that Azusa Pacific owed a special duty to its students to provide them with a reasonably safe method to travel between the east and west campuses.
In her lawsuit, Farris is asking for general damages; past and future hospital, medical and other health care expenses; loss of wages and/or earning capacity, both past and future; and court costs.
